17. Governing Law
Except to the extent preempted by the Federal Arbitration Act, these Terms and any dispute arising out of or relating to the Site or these Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
18. Dispute Resolution; Arbitration; Class Action Waiver
Please read this section carefully. It affects your legal rights.
Except for matters that may be brought in small claims court or requests for temporary or preliminary injunctive relief as described below, you and FCDR agree that any dispute, claim, or controversy arising out of or relating to the Site, these Terms, or your access to, use of, or submission of information through the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its applicable consumer rules. The Federal Arbitration Act governs the interpretation and enforcement of this Section.
Before starting arbitration, either party must first send the other a written Notice of Dispute describing the nature of the dispute and the relief sought. Any Notice of Dispute to FCDR must be sent to:
First Choice Debt Relief, Inc.
Attn: Legal – Notice of Dispute
530 Technology Drive, Suite 100
Irvine, CA 92618
Email: info@firstchoicedebtrelief.com
The parties agree to attempt in good faith to resolve the dispute informally for 60 days after the Notice of Dispute is received. During that period, either party may request an individualized settlement conference by telephone or video conference, and the parties will reasonably cooperate in scheduling it. If the dispute is not resolved within that 60-day period, either party may begin arbitration.
Any arbitration shall be conducted on an individual basis only. Neither you nor FCDR may bring any claim as a plaintiff, claimant, or class member in any purported class, collective, coordinated, consolidated, mass, private attorney general, or representative proceeding. The arbitrator shall have no authority to hear or arbitrate any class, collective, coordinated, consolidated, mass, private attorney general, or representative claim, or to award relief to anyone other than the individual party in arbitration.
Either party may bring an individual claim in small claims court if it qualifies and remains in that court. Either party may also seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect confidential information, intellectual property, or security interests pending completion of arbitration.
The arbitrator shall have exclusive authority to decide any dispute relating to the interpretation, applicability, enforceability, formation, or scope of this arbitration agreement, except to the extent applicable law provides otherwise.
Unless otherwise required by applicable AAA rules or law, the arbitration shall be conducted in Orange County, California, or by remote means if permitted by the arbitrator or applicable rules.
To the extent any dispute proceeds in court, including any action to compel arbitration, stay proceedings pending arbitration, confirm, vacate, enforce, or enter judgment on an arbitration award, or seek temporary or preliminary injunctive relief, the parties agree to the exclusive jurisdiction of the state and federal courts located in Orange County, California, and waive any objection based on personal jurisdiction, venue, or forum non conveniens, except that a qualifying individual action may be brought in small claims court.
Payment of filing fees, administrative fees, and arbitrator compensation shall be governed by applicable AAA rules and applicable law. Each party shall bear its own attorneys’ fees and costs except as otherwise provided by contract, statute, rule, or applicable law, or as awarded by the arbitrator on a basis permitted by law.
You may opt out of this arbitration agreement by sending written notice within 30 days after your first use of the Site or first submission of information through the Site while these Terms are in effect. Your opt-out notice must include your full name, address, telephone number, email address, and a clear statement that you wish to opt out of arbitration. Send it to:
First Choice Debt Relief, Inc.
Attn: Legal – Arbitration Opt-Out

To the maximum extent permitted by law, any claim arising out of or relating to the Site or these Terms must be commenced within one (1) year after the claim arose or, if later, within one (1) year after the claim could reasonably have been discovered, or it will be permanently barred.
This Section 18 survives termination of these Terms, your use of the Site, and any communications or relationship between you and FCDR relating to the Site.
19. Jury Trial Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IF ANY DISPUTE PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND FCDR EACH WAIVE THE RIGHT TO A JURY TRIAL.
20. Class Action Waiver for Court Proceedings
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IF ANY DISPUTE PROCEEDS IN COURT RATHER THAN ARBITRATION, IT SHALL PROCEED ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, COLLECTIVE, COORDINATED, CONSOLIDATED, MASS, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION.
21. Severability
If any provision of these Terms is held unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or, if that is not possible, deemed severed, and the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
If any portion of Section 18 is found invalid or unenforceable, that portion shall be modified to the minimum extent necessary to make it enforceable and to reflect the original intent of the parties as closely as possible. If modification is not possible, that portion shall be severed and the remainder of Section 18 shall remain enforceable to the fullest extent permitted by law. However, if the waiver of class, collective, coordinated, consolidated, mass, private attorney general, or representative proceedings is found unenforceable as to a particular claim or request for relief, then that claim or request for relief shall proceed in a court of competent jurisdiction and not in arbitration, to the maximum extent permitted by law.
22. Entire Agreement; No Reliance
These Terms, together with the Privacy Policy and any other legal notices expressly incorporated by reference, constitute the entire agreement between you and FCDR regarding your use of the Site and supersede all prior or contemporaneous understandings regarding that subject matter. You acknowledge that, in using the Site, you are not relying on any statement, representation, promise, or assurance not expressly set forth in these Terms.
